UPDATE ON SB 344

On the SB 344, “Radian” front, it is important to note that the recent defeat of the bill in the Senate Insurance Committee does not mean that the issue is dead. First, Commissioner Garamendi and the Department of Insurance have taken jurisdiction over the legal question of whether the lien protection product is in fact title insurance, and a decision is expected within a few months. Second, since the California Legislature operates on two-year sessions, AB 344 will remain alive into 2004, and, could be amended or voted upon again, most likely in January. CEA members are urged to watch for communication from CEA and CLTA, and be prepared to once again make calls or write letters in opposition to the bill, as the need arises.

The CEA Forms and Practices Committee is requesting your HELP. The Forms and Practices Committee met recently in Sacramento. One of the major Forms and Practices issues is with the Lenders. It was suggested by Mike Belote (CEA’s Legislative Advocate) that the committee start a list of these issues and the problems that we continue to have with all aspects of the new loan processing. Once this information is compiled, Mr. Belote will be able to take our issues and concerns to the appropriate lender associations.
